{"id":9723,"date":"2024-04-26T14:00:11","date_gmt":"2024-04-26T11:00:11","guid":{"rendered":"https:\/\/ch.jfdi.cc\/?p=9723"},"modified":"2024-04-26T14:00:11","modified_gmt":"2024-04-26T11:00:11","slug":"82-year-old-shooter-s-appeal-for-freedom-rejected","status":"publish","type":"post","link":"https:\/\/ch.jfdi.cc\/?p=9723","title":{"rendered":"82-year-old shooter, \u2019s appeal for freedom rejected"},"content":{"rendered":"<div><img decoding=\"async\" src=\"http:\/\/ch.jfdi.cc\/wp-content\/uploads\/2024\/04\/82-year-old-shooter-s-appeal-for-freedom-rejected.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p>An 82-year-old who was jailed for shooting a cable thief in March <strong>had an appeal for his sentence to be commuted to a suspended sentence rejected<\/strong> on Friday.<\/p>\n<div class=\"cypru-video-ads\" id=\"cypru-2117768666\">\n<div id=\"cypru-2005947729\" data-cypru-trackid=\"478051\" data-cypru-trackbid=\"1\" class=\"cypru-target\">\n<div id=\"gpt-ad-5247487609311-0\">\n<\/div>\n<\/div>\n<\/div>\n<p>During proceedings at the appeals court, Deputy Attorney-General Savvas Angelides said the sentence handed down \u201cis not manifestly excessive\u201d.<br \/>\nHowever, he said, the legal service would file no objection should the sentence be suspended, given the man\u2019s age and the health problems he is facing.<br \/>\nDespite this, the court rejected his appeal in a two-to-one verdict.<br \/>\nSpeaking to Alpha television after the conclusion of court proceedings, the man\u2019s lawyer Maria Neophytou said <strong>she is now awaiting the attorney-general\u2019s position on the matter of a presidential pardon<\/strong>.<br \/>\nPresident Nikos Christodoulides had in March issued instructions to the legal service to grant the man a pardon, but the intricacies of the Republic of Cyprus\u2019 constitution mean the final decision regarding a pardon cannot be taken unanimously by the president but must be done in tandem with the legal service, and with the agreement thereof.<br \/>\nThe fourth annex of Article 53 of the constitution states that the president or the vice president can \u201cremit, suspend, or commute any sentenced passed by a court in the Republic.\u201d<br \/>\nHowever, it stipulates that this can only be done \u201c<strong>on the unanimous recommendation of the attorney-general and the deputy attorney-general<\/strong>.\u201d<br \/>\nWith the realities of the Cyprus problem meaning there is no vice president, and the president having made his opinion clear, the 82-year-old\u2019s fate now lies in the hands of Attorney-General George Savvides and his deputy Savvas Angelides.<br \/>\nDeputy government spokesman Yiannis Antoniou had said last month that the attorney-general\u2019s office was blocking the issuing of a pardon.<br \/>\n\u201cThe initial reaction of the attorney-general\u2019s office is not in line with the opinion of the president, which is why the president disagrees with this approach of <strong>the legal service, which sees the issue in purely legal terms<\/strong>,\u201d he said.<br \/>\nHe added that Christodoulides\u2019 intervention \u201chad a different motive\u201d and \u201carose for humanitarian reasons\u201d.<br \/>\nHowever, Angelides\u2019 intervention in court on Friday may suggest the legal service has moved on the issue and may now be more willing to consider the matter.<br \/>\nThe man had been sentenced to two and a half years behind bars after having been convicted of intending to cause serious bodily harm and carrying and using a firearm.<br \/>\nThe shooting had taken place in the Limassol village of Alassa last June. The 82-year-old exited his house during a power outage to check the main supply panel and took a hunting rifle and a cartridge with him for protection.<br \/>\nHe then realised that someone else was on his property and winding an electric wire. He then approached the perpetrator and <strong>shouted at him, before firing a shot, which hit him in the back<\/strong>.<br \/>\nThe thief was initially hospitalised and intubated, but later made a full recovery.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An 82-year-old man who was jailed for shooting a cable thief had his appeal for a suspended sentence rejected.
