{"id":9641,"date":"2024-04-25T20:00:50","date_gmt":"2024-04-25T17:00:50","guid":{"rendered":"https:\/\/ch.jfdi.cc\/?p=9641"},"modified":"2024-04-25T20:00:50","modified_gmt":"2024-04-25T17:00:50","slug":"harvey-weinstein-s-conviction-overturned-by-top-ny-court","status":"publish","type":"post","link":"https:\/\/ch.jfdi.cc\/?p=9641","title":{"rendered":"Harvey Weinstein, \u2019s conviction overturned by top NY court"},"content":{"rendered":"<div><img decoding=\"async\" src=\"http:\/\/ch.jfdi.cc\/wp-content\/uploads\/2024\/04\/harvey-weinstein-s-conviction-overturned-by-top-ny-court.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p>New York\u2019s highest court on Thursday overturned the 2020 sex crimes conviction of former Hollywood producer Harvey\u00a0Weinstein, in the case that helped\u00a0to create\u00a0the #MeToo movement.<\/p>\n<div class=\"cypru-video-ads\" id=\"cypru-1818124798\">\n<div id=\"cypru-935565515\" data-cypru-trackid=\"478051\" data-cypru-trackbid=\"1\" class=\"cypru-target\">\n<div id=\"gpt-ad-3720915169283-0\">\n<\/div>\n<\/div>\n<\/div>\n<p>In a 4-3 decision, the state Court of Appeals said the trial judge made a critical mistake by letting prosecutors introduce testimony from women who claimed that\u00a0Weinstein\u00a0assaulted them, even though they were not part of the charges he faced.<br \/>\nThe court also said the trial judge compounded the error by letting\u00a0Weinstein\u00a0be cross-examined in a way that portrayed him in a \u201chighly prejudicial\u201d light.<br \/>\n\u201cIt is an abuse of judicial discretion to permit untested allegations of nothing more than bad behavior that destroys a defendant\u2019s character but sheds no light on their credibility as related to the criminal charges,\u201d Judge Jenny Rivera wrote for the majority.<br \/>\n\u201cThe remedy for these egregious errors is a new trial,\u201d she added.<br \/>\nA dissenting judge, Madeline Singas, said the outcome \u201cperpetuates outdated notions of sexual violence and allows predators to escape accountability.\u201d<br \/>\nWeinstein,\u00a072,\u00a0has been serving a 23-year prison sentence, after being convicted in February 2020 of sexually assaulting a former production assistant in 2006, and raping an aspiring actress in 2013.<br \/>\nIt will be up to Manhattan\u00a0District Attorney Alvin Bragg, whose predecessor Cyrus Vance brought the case, to decide\u00a0how to proceed.<br \/>\n\u201cWe will do everything in our power to retry this case, and remain steadfast in our commitment to survivors of sexual assault,\u201d Emily Tuttle, a spokesperson for Bragg, said in an email.<br \/>\nBragg\u2019s office is separately in the middle\u00a0of a criminal hush money trial against former U.S. President Donald Trump.<br \/>\nA lawyer for\u00a0Weinstein\u00a0did not immediately respond to a request for comment.<br \/>\nIt was not immediately clear how the decision would affect\u00a0Weinstein, who has been serving his sentence in upstate New York.<br \/>\nEven if he were not retried, he still faces a separate 16-year prison sentence in California after being convicted there last year for the 2013 rape of an actress in Los Angeles.<br \/>\nWeinstein\u2018s original conviction\u00a0was considered a milestone for #MeToo, in which women have accused hundreds of men in entertainment, media, politics and other fields of sexual misconduct.<br \/>\n\u201cToday\u2019s decision is a major step back in holding those accountable for acts of sexual violence,\u201d said Douglas Wigdor, a lawyer who represented eight of\u00a0Weinstein\u2018s accusers. \u201cIt will require the victims to endure yet another trial.\u201d<br \/>\nWeinstein\u00a0co-founded the Miramax film studio, whose hit movies included \u201cShakespeare in Love\u201d and \u201cPulp Fiction.\u201d His own eponymous film studio filed for bankruptcy in March 2018.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>New York&#8217;s highest court overturned Harvey Weinstein&#8217;s 2020 sex crimes conviction due to critical mistakes made by the trial judge.
