\u00a0Hunter\u00a0Biden\u2019scriminal trial\u00a0on gun charges\u00a0kicked off on\u00a0Tuesday\u00a0witha government lawyer telling jurors that President Joe\u00a0Biden\u2019s son was being prosecuted for lying on a form he filled out to purchase a handgun and was not above the law.Derek Hines, a Department of Justice lawyer, began his opening arguments by walking jurors through the events of October 2018, when Hunter\u00a0Biden\u00a0purchased the gun but allegedly lied on his background check about his drug use.<\/p>\n

\u201cIt was illegal because he was user of crack and a drug addict,\u201d Hines told the jury. \u201cNo one is above the law.\u201d<\/p>\n

Hunter\u00a0Biden, 54, pleaded not guilty to the\u00a0three felony chargesaccusing him of failing to disclose his use of illegal drugs when he bought a Colt Cobra .38-caliber revolver and of illegally possessing the weapon for 11 days in October 2018.<\/p>\n

\u201cHunter bought a small handgun. It was never loaded. He never used it. It was thrown out 11 days later by the person he was dating at the time. Just 11 days later,\u201d Abbe Lowell,\u00a0Biden\u2019s attorney, told jurors. \u201cFor this, three felonies.\u201d<\/p>\n

The\u00a0trial at\u00a0the federal courthouse in the\u00a0Bidens\u2019 hometown of Wilmington, Delaware,\u00a0gets underway\u00a0just days after Republican\u00a0Donald Trump,\u00a0who is challenging\u00a0Democratic President Joe\u00a0Biden\u00a0in\u00a0the\u00a0Nov. 5 U.S. election, became the first former president\u00a0found guilty of a crime.<\/p>\n

Hunter\u00a0Biden\u00a0has discussed publicly and in his 2021 autobiography, \u201cBeautiful Things,\u201d his years-long crack cocaine use and addiction.<\/p>\n

He told U.S. District Judge Maryellen Noreika at a hearing last year that he has been sober since the middle of 2019.<\/p>\n

U.S. Special Counsel David Weiss is expected to call FBI agent Erika Jensen to testify about Hunter\u00a0Biden\u2019s messages discussing his drug use.<\/p>\n

\u201cI was sleeping on a car smoking crack on 4th Street and Rodney,\u201d was one of the messages prosecutors disclosed in a court filing. In another, Hunter\u00a0Biden\u00a0said he was behind a minor league baseball stadium in Wilmington \u201cwaiting for a dealer named Mookie.\u201d<\/p>\n

Prosecutors said they may call as a witness his former wife, Kathleen Buhle, who accused Hunter\u00a0Biden\u00a0in their 2017 divorce proceedings of squandering money on drugs, alcohol and prostitutes.<\/p>\n

Twelve jurors and four alternates\u00a0were sworn in\u00a0on Monday, many describing their own experiences with family members and friends battling substance abuse. All 12 jurors must agree Hunter\u00a0Biden\u00a0is guilty beyond a reasonable doubt to convict.<\/p>\n

Weiss, a Trump appointee, has hit Hunter\u00a0Biden\u00a0with federal\u00a0tax charges\u00a0separately in California.<\/p>\n

The trial comes days after\u00a0Trump was convicted\u00a0by a jury in state court in New York of 34 felony counts of falsifying documents to cover up hush money paid to a porn star to avoid a sex scandal shortly before the 2016 U.S. election that put him in the White House.<\/p>\n

Hunter\u00a0Biden\u2019s trial gives Republicans a chance to shift attention away from Trump\u2019s legal troubles.<\/p>\n

Trump is due to be sentenced in New York on July 11. He has pleaded not guilty in\u00a0three other pending criminal cases, two related to his efforts to overturn his loss in 2020 to\u00a0Biden\u00a0and one charging that he unlawfully kept classified national security documents after leaving office in January 2021.<\/p>\n

If convicted on all charges in the Delaware case, Hunter\u00a0Biden\u00a0faces up to 25 years in prison, though defendants generally receive shorter sentences, according to the U.S. Justice Department.<\/p>\n

Noreika, also a Trump appointee, entered multiple orders over the weekend that were requested by prosecutors and that appeared to undercut\u00a0Biden\u2019s legal strategy.<\/p>\n

The judge said\u00a0Biden\u2019s legal team could not introduce expert testimony that people suffering from substance abuse disorder might not consider themselves an addict.<\/p>\n","protected":false},"excerpt":{"rendered":"
