{"id":12645,"date":"2024-05-21T20:01:08","date_gmt":"2024-05-21T17:01:08","guid":{"rendered":"https:\/\/ch.jfdi.cc\/?p=12645"},"modified":"2024-05-21T20:01:08","modified_gmt":"2024-05-21T17:01:08","slug":"small-island-states-secure-historic-climate-win-at-international-ocean-court","status":"publish","type":"post","link":"https:\/\/ch.jfdi.cc\/?p=12645","title":{"rendered":"Small island states secure historic, \u00a0climate\u00a0win at international ocean court"},"content":{"rendered":"<div><img decoding=\"async\" src=\"http:\/\/ch.jfdi.cc\/wp-content\/uploads\/2024\/05\/small-island-states-secure-historic-climate-win-at-international-ocean-court.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p>By Riham Alkousaa<\/p>\n<div class=\"cypru-video-ads\" id=\"cypru-718376572\">\n<div id=\"cypru-1923560733\" data-cypru-trackid=\"478051\" data-cypru-trackbid=\"1\" class=\"cypru-target\">\n<div id=\"gpt-ad-7747749027278-0\">\n<\/div>\n<\/div>\n<\/div>\n<p>A group of small island states including Antigua and Barbuda and the Bahamas secured a win on\u00a0climate\u00a0change in an international court on Tuesday as they seek to combat rising sea levels.<br \/>\nIn its first-ever\u00a0climate-related judgement, The International Tribunal for the Law of the Sea (ITLOS) said that greenhouse gas emissions absorbed by the ocean are considered marine pollution and countries are obliged to protect marine environments by going further than required under the Paris\u00a0climate\u00a0agreement.<br \/>\nThe opinion was requested by a group of nine island nations facing\u00a0climate-driven rises in sea levels.<br \/>\nThe opinion is not legally binding but it will be able to help guide countries in their\u00a0climate\u00a0policy and will be able to be used in other cases as legal precedent.<br \/>\n\u201cThe ITLOS opinion will inform our future legal and diplomatic work in putting an end to inaction that has brought us to the brink of an irreversible disaster,\u201d Antigua and Barbuda\u2019s Prime Minister Gaston Browne said.<br \/>\nThe other nations in the group that brought the case were Tuvalu, Palau, Niue, Vanuatu, St.Lucia, St Vincent and Grenadines and St Kitts and Nevis.<br \/>\nThe court said states are legally obligated to take all necessary measures to achieve the goal of keeping global warming to 1.5 degree Celsius above pre-industrial levels according to the UN Convention on the Law of the Seas.<br \/>\nIn the case hearings in September, China, the world\u2019s biggest carbon polluter, had challenged the islands\u2019 request, arguing that the tribunal does not have general authority to issue advisory opinions. Beijing said its position was taken to avoid the fragmentation of international law.<br \/>\n\u201cIf ITLOS were to find that such an obligation exists, Beijing\u2019s response would most likely be to characterise this as falling outside of its proper scope of authority,\u201d said Ryan Martinez Mitchell, law professor at the Chinese University of Hong Kong.<br \/>\nEselealofa Apinelu, a representative of the South Pacific island of Tuvalu, said the advisory opinion spells out the legally binding obligations of all states to protect the marine environment and the states against the existential threats posed by\u00a0climate\u00a0change.<br \/>\n\u201cThis is a historic moment for small island developing nations in their request for\u00a0climate\u00a0justice, an important first step in holding the major polluters accountable, for the sake of all humankind,\u201d Apinelu said.<br \/>\nClimate\u00a0activists and lawyers said the decision could also influence two upcoming legal opinions by the Inter-American Court on Human Rights, and the International Court of Justice \u2013 which are also considering states\u2019\u00a0climate\u00a0obligations.<br \/>\nLast month, the European Court of Human Rights issued a historic ruling in favour of plaintiffs who argued that Switzerland was violating their human rights by not doing enough to combat\u00a0climate\u00a0warming.<br \/>\n\u201cNow we have clarity on what states are obligated to do which they have failed to do through 30 years \u2026 but this is the opening chapter,\u201d Payam Akhavan, lead counsel for the nine island nations in the proceedings, said of ITLOS\u2019 opinion, adding that the next step was to ensure that major polluters would implement their obligations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A group of small island states, including Antigua and Barbuda and the Bahamas, secured a win on climate change in an international court.
