{"id":12479,"date":"2024-05-20T16:01:06","date_gmt":"2024-05-20T13:01:06","guid":{"rendered":"https:\/\/ch.jfdi.cc\/?p=12479"},"modified":"2024-05-20T16:01:06","modified_gmt":"2024-05-20T13:01:06","slug":"assange-wins-permission-to-appeal-us-extradition","status":"publish","type":"post","link":"https:\/\/ch.jfdi.cc\/?p=12479","title":{"rendered":"Assange wins permission to appeal US extradition"},"content":{"rendered":"<div><img decoding=\"async\" src=\"http:\/\/ch.jfdi.cc\/wp-content\/uploads\/2024\/05\/assange-wins-permission-to-appeal-us-extradition.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p>WikiLeaks founder Julian\u00a0Assange\u00a0was given permission to have a full appeal over his extradition to the United States after arguing at\u00a0London\u2019s High Court on Monday\u00a0he might not be able to rely on his right to free speech\u00a0at a trial.<br \/>\nTwo judges at the High Court said they had given him leave to have a full appeal to hear his argument that he might be discriminated against on the basis the Australian-born\u00a0Assange\u00a0is a foreign national.<br \/>\nHundreds of protesters\u00a0had gathered\u00a0outside the court ahead of what\u00a0was a key ruling after\u00a013 years of legal battles, with two judges asked\u00a0to declare whether they were satisfied by U.S. assurances that\u00a0Assange, 52, could\u00a0rely on the First Amendment right if he is tried for spying in the U.S.<br \/>\nThe news was met outside court by an eruption of cheering and singing.\u00a0Assange\u2018s legal team\u00a0had said if he lost\u00a0he could be on a plane across the Atlantic within 24 hours.<br \/>\nHis lawyer Edward Fitzgerald\u00a0had told\u00a0the judges\u00a0they\u00a0should not accept the\u00a0assurance given by U.S. prosecutors\u00a0that\u00a0Australian-born\u00a0Assange\u00a0could seek to rely upon the rights and protections given under the First Amendment, as a U.S court would not be bound by this.<br \/>\n\u201cWe say this is a blatantly inadequate assurance,\u201d he told the court.<br \/>\nFitzgerald\u00a0had\u00a0accepted a separate assurance that\u00a0Assange\u00a0would not face the death penalty, saying the U.S. had provided an \u201cunambiguous promise not to charge any capital offence\u201d.<br \/>\nThe U.S. said its First Amendment assurance\u00a0was\u00a0sufficient. James Lewis, representing the U.S. authorities, said\u00a0it made clear that\u00a0Assange\u00a0would not be discriminated against because of his nationality in any U.S. trial or hearing.<br \/>\nAsaange\u2019s legal team were buoyant after the decision was made.
